What is the standard of care in a medical malpractice case?

People who seek out medical care assume that they will receive a proper diagnosis followed by treatment to address the problem. All medical professionals should provide care that meets or exceeds certain standards, but those standards aren’t always the same. 

There are several factors that go into determining the level of care that someone should receive. Understanding these factors is critical if a patient believes they haven’t gotten the level of care they should have from their medical team. 

What factors play a role in standard of care?

The primary factors that go into the standard of care include the information available about the patient, the training of the doctor and the technology available. These can often be profoundly different from one case to another. 

A family practitioner will likely have a more comprehensive medical history, which can make it easier for them to make a diagnosis than what would be possible for an emergency department doctor who has a limited medical history on the patient. 

A doctor who has specialized training in neurosurgery would be held to a higher standard than a general practitioner. This is based on the additional training of the neurosurgeon. 

A patient who’s seen at a large medical facility that has state-of-the-art technology should seek a higher level of care than a patient who’s seen in a rural office. 

These cases can often be challenging, partially because they may require expert testimony. The medical community is tight-knit, which can make finding an expert challenging. The expert who works with the patient has to understand all the factors that have to go into determining the standard of care, and they have to be able to relay those in an effective manner. 

Medical malpractice and negligence can lead to worsened health for the patients. This can cause financial difficulties because of the additional care that’s needed. Learning a bit about what role the standard of care has in these cases may help patients determine how to proceed with their claim.
