Should I address a business dispute through litigation?

On Behalf of Hantzes & Associates | May 29, 2023 | Business Litigation |

Litigation is one of several ways to resolve business disputes. Some people hesitate to use it, but there will be times when this approach might become your best course of action. Here are signs it is best to resolve a business dispute through litigation.

Communication does not work

Communication is critical to ironing out conflict, but if the other party ignores you, responds with hostility or threatens legal action, it might be time to consider going to court.

Alternative methods led nowhere

Some consider alternative dispute resolution solutions but do not achieve the meaningful outcomes they want. If you have already tried alternatives or have reason to believe they might not work, then litigation might be your best choice.

You do not mind records going public

Court records are generally accessible to the public, and the outcome of your case may become a precedent for similar cases in the future. Therefore, it is often best to prosecute if the dispute does not include details about your business that you would rather remain confidential.

Your lawyer thinks litigation is a good move

If you find yourself involved in a business dispute, consulting with your lawyer can help you find different ways to address the conflict. With their knowledge of business law, they can evaluate the circumstances of the dispute and might be able to confirm if taking legal action is likely to give you the outcomes you want.

Business law is complex and constantly evolving. During a business dispute, a business law attorney can help you fight for your rights and improve your chances of achieving your goals.
